I was asked to behead my mother by Mungiki, man says

At the naïve age of 16, Peter Jomo Macharia joined the then dreaded Mungiki sect. In 2000, lured by promises of good life, protection from aggressors and the call to restore the Kikuyu culture, he agreed to become a member. He had seen how some members had made a life for themselves and their families mainly through extortions in the guise of offering security and keeping law and order.

As a teenager, he was excited and did whatever he was asked to do without asking questions. As initiation, he says, one is beaten and tortured. Those who endure the violent induction that includes military like drills, then go through an oathing process. They have to promise never to discuss what goes on in the sect or desert duty. Jomo passed the test.

Now, he could ‘go out on missions as ordered by his superiors’. He attacked and maimed people without asking questions. For this, he was a favourite with the leadership. On his part, he imagined he was already on the path to ‘greatness’ four years after took an oath and swore to be a member. However, their demand to ascend to greatness left Jomo dead in his tracks. They wanted his mother’s head on a plate as a show of devotion and dedication to the sect.

The 28-year-old could not control his tears while narrating his chilling and nerve wrecking confession. He was flanked by the same mother he was asked to kill. “After two years, I was to be ‘ordained’,” Jomo recounts. In 2002, Jomo, who dropped from school in Class Two, was invited to attend an important sect meeting at Maili Sita in Bahati, Nakuru County.

It was the ‘ordination’, but he did not know that until he arrived there. At the ceremony in a dark house, a group of about 130 young men sat in two groups. The ‘graduands’ and the rest who were still undergoing training. The oath was being administered in a poorly lit mud house away from general public. “The oath included meat and blood. I am not sure if it was from an animal or a human being since it was dark,” he says.

The oathing is something that is never discussed. The ‘graduands’ were divided into groups of 10 and told to enter a pitch dark room naked. After a while, some people descended on them beating them senseless. Anyone who screamed, was out. The next stage was to confirm if all of them were circumcised. “Unfortunately, one of us was not cut and he was circumcised on the spot,” says Jomo. They then poured tobacco on him.

The sect believes tobacco is also some kind of medicine. The ceremony lasted 10 hours and before Jomo and the rest left, any sort of humanness in them had been drained. They were expected to be merciless and ruthless. While listening and speaking to the leaders during the oath, one the graduands had to be on their knees and the head bowed. When it was about time to take the last oath, it dawned on Jomo there was no turning back. “We were asked if we would bring anything the leaders wanted from us. We all agreed,” he says.

“Will you bring the head of your, mother, father, sister and brother to us if asked?” they asked. Already beaten senseless and hardened, the young men said they would. After the torturous night, Jomo was unable to go home due to injuries he had on his body. He sought refuge at one of the member’s house since he could not face his parents who knew nothing about his association with Mungiki.

A week later, in early 2003 Jomo was sent for a revenge mission after one member of his group was attacked. “The assignment was at Bahati. A shopkeeper had assaulted our member. I contemplated killing the man, but I changed my mind,” he says. However, he slit the man’s thigh with a sword. The attack left the man disabled. Jomo regrets maiming the man, but says he is afraid of confronting the man and asking for forgiveness.

After the mission, his seniors in Nakuru were impressed and booked an appointment with the former Mungiki leader Maina Njenga, who he alleged gave him a sword and advised him to continue working. Years ago, Njenga renounced the sect and converted to Christianity. Jomo says this could also have motivated him to leave the dark sect and is now a member of Gospel Campaigners Fellowship in Nakuru where he also reaches out the youth especially those still in the sect.

I had been assigned to control 80 members in Nakuru CBD. Some members are responsible for killing deserters. Jomo with other members have been involved in deadly clashes in Nakuru, which left many injured and others dead. He points out that they used to extort money, engage in fraud, robbery, murder and even kidnapping. He jolted back into reality after he was given 21 days to take his mother’s head.

Jomo says he knew they meant business because he had seen the leaders behead three young men for deserting the group. “That is how I decide stay indoors for three weeks,” he says. However, his move left his family in grave danger, because sect members kept visiting his mother asking of Jomo’s where about. He thanks God that they did not turn on his family because sect members are known to harm families of deserters.

However, he could not hide for long because within a short time, his former sect followers were looking for him. Usually, to scare their target. They visit their homes, walk around and leave without saying a word. “I stayed indoors for three weeks in my mother’s house and some people were sent to spy on me,” he says. This prompted him to seek refuge with relatives in Elburgon. They declined to take him in fearing the consequences of their hospitality.

He then went to hide in Mau Forest for four months. When things got tough, Jomo says he resolved to go face the sect. “I was ready to die. I could not run away for ever,” he says. When he got there, he got word that police were also looking for him in connection to various crimes in Nakuru. “It was at this time I confessed to my mother I had been a member of the outlawed Mungiki,” he says.

Martha Macharia, a mother of five, listened to her son’s confession and was shocked to hear she would have been a sacrificial lamb. “I thank God that never happened,” She says. His mother says she knew all was not well with her son. Family members feared him and he had little interest in what the rest of them were doing. “It pains me to hear the confession of my son that he made people cripples but thank God this testimonies may liberate many youths who are in the verge of joining terrorism, Mungiki or other groups,” he says.

His family says it has forgiven him and embraced his transformation and he continues to be an inspiration to others who think there is no hope. “I continue receiving threats though they have subsided. I am not at peace when I met the people whose lives I ruined, but I pray God one day I will meet them and ask for forgiveness to clear my conscience,” he says.

Jomo says that to lead a group of several members, one must have proven himself by being lethal and heartless, especially when sent out on revenge missions. The more followers assigned to a group leader, the powerful they are. “One was promoted for carrying out a revenge mission with brutality and courage.

Killing was not a must, but it was one of the options when necessary,” he says. Surprisingly, followers in charge of extorting money from matatus are poor and barely get any of the money. Top national leaders divide the money among themselves. He says 10 years ago, each member was required to contribute Sh20 daily. Jomo’s group used to contribute Sh50,000. The former sect follower says he once overheard that the sect was making Sh2-3 million from followers every month. “I am sure now they collect a lot of money,” he says.

How sect exploits followers

The top leadership reign was filled with terror and they kept followers guessing on what the next mission would be. The leadership called impromptu meetings, sometimes in far off areas just to see which followers would fail to attend. According to Jomo, the sect is run like a rebel military camp where generals have an air of mystery around them.

He says revenge missions were often planned by the national leadership and instructions communicated to those in the grassroots. Indoctrination is a key weapon in the sect. Jomo says the fact that followers saw themselves as the economic, political and social saviours of the Kikuyu community hardened their resolve despite the violence sometimes meted on them.

The members of the sect disrespect women especially the uncircumcised and they equate them to children who have no say in the society. He says his group sometimes publicly undressed women deemed to be improperly dressed. Jomo says the sect does nothing more than turn followers into slaves and prisoners. Followers often operate like sheep and most of the time sit and wait for instructions on how to run their lives.

The cost of deserting the sect is death, but Jomo says he is a Christian now and believes God will not let harm come his way. At the end of the interview, he shakes his head at the thought of thousands of youth still bound by the yokes of the sect. He hopes the leadership could resolve some of the issues like unemployment and tribalism that lure the youth to such criminal gangs.

We will kill you if you ask for rent, Kibera tenants tell landlords

They are the tenants from hell.

Landlords in Kibera slums are living in terror because their tenants attack them whenever they go to collect rent.

Three of them this week told of T beatings and death threats whenever they tried to collect their rents.

One, Mr Joseph Ngige, was roughed up by his tenants when he went to collect his rent from his 30 units at Gatwekera.

New tenant “One of the tenants who has refused to pay rent since 2007 had installed a new tenant in the house so I went there to ask him why he was doing that. That is when he rained blows on me,” Mr Ngige said.

And he added: “He called me and told me that if he had to leave the house, he would ensure I’m dead and my houses burnt to the ground.” Mr Ngige said he had unable to collect rent from the 30 tenants since they forced their way into the Sh2,500 a month bedsitters in 2007.

Although he still lives in the area, Mr Ngige operates in secret so noone knows exactly where he lives, to protect his family.

Most of the landlords have moved away after receiving death threats and being roughed up by the rowdy tenants. The Administration is seemingly helpless with dozens of summons by the chief routinely ignored.

Another landlord, Mr Joseph Njoroge, said he had not gone back to Kibera since the 2007 post election violence when he was badly beaten.

“They threatened to kill me if I ever go back there. I can’t risk my life or that of my family,” he said Mr Njoroge now lives in Juja and said efforts through the chief to have the tenants in his 80 units pay rent had borne no fruit.

“When you go there you find the houses locked or just the wife is around. She will tell you that it’s the husband who pays the rent,” said Mr Njoroge.

Mr David Muganda, another landlord, said that when pushed to the wall by the District Officer, some of the tenants had moved out, only to rent out the houses to third parties without the landlord’s knowledge.

He does not collect rent from 10 of his 20 units ,with one that used to be a shop now closed down. Rents in the houses range from Sh800 to Sh1,500.

“I recently tried to evict one of the tenants and in no time, eight of them were there. They attacked me and I had to run away before they seriously injured me. I had one arrested after that but they bailed him out,” said Mr Muganda who has many hospital and police records following physical confrontations.

Local level Area Ward Rep Pius K’Otieno said that while there had been issues relating to the refusal of some tenants to pay rent, they could be settled at local level.

“Issues of tenants and landlords can be settled at community level.

What we need is serious communication between landlords, tenants and the chiefs,” he said.

He added that for those who had very difficult tenants, there was a procedure to deal with them, including their paying rent to the chief, from whom the landlord can then collect his money.

Mr K’Otieno added that some defaults were as a result of poor service by some landlords who demanded payment but did not improve the homes.

NBC Nightly News on Tuesday 5/6/14 at 6:30pm reported that hundreds of girls had been abducted in Kenya. A Kenyan man Anthony Thuo seeks a correction from the media house as the incident was not in Kenya but in Nigeria and this may have a negative impact on Kenya.

We however pray with Nigeria for the Girls to be brought back safe and unharmed. “It now feels like the whole world knows and is responding to the kidnapping of 276 school girls in Kenya, three weeks ago today,” Williams started his broadcast.

He went on to say..”In the meantime we learn that 8 more female students have been abducted in Kenya….”

Spouses of Some H-1B Visa Holders to Be Allowed to Work in US

Spouses of H-1B visa holders being sponsored for a green card by their employers will be allowed to work in the U.S. as part of a new initiative by the Obama administration to attract high-skilled foreign workers.

Deputy Secretary of Homeland Security Alejandro Mayorkas and Commerce Secretary Penny Pritzker announced Tuesday that the administration plans this and other revisions to regulations for the H-1B and other skilled-worker visas.

Mr. Mayorkas said the goal was twofold: to “encourage highly skilled, specially trained individuals to remain in the United States” and to maintain U.S. “competitiveness with other countries that attract skilled foreign workers and offer employment authorization for spouses.”

Ms. Pritzker said that 28% of new U.S. businesses are launched by immigrants, who represent 13% of the population, and that four of 10 Fortune 500 companies were started by immigrants or their children. She mentioned Andy Grove, the former CEO of IntelCorp. INTC +0.11% , who was born in Hungary; Google Inc. co-founder Sergey Brin, born in Russia; and Jerry Yang, who co-founded Yahoo and is originally from Taiwan.

The rules, which will be published soon in the Federal Register, are expected to go into effect after a 60-day public-comment period.

Congress allows 85,000 new H-1B visas to be issued each year, 20,000 of which are reserved for people with advanced degrees. Under existing regulations, the Department of Homeland Security doesn’t extend employment authorization to dependents of H-1B visa holders, who normally have specialized skills in engineering, programming and other high-tech fields.

The decision stops short of giving spouses of all H-1B visa holders blanket approval to work in the U.S. Spouses would become eligible only after the visa holder’s company has petitioned for an immigrant visa for the foreign employee, putting the employee on track for legal permanent residency, known as a green card. Lawful permanent residents generally qualify to become U.S. citizens after five years.

“Allowing H-1B spouses to work would be an important change. Sometimes people aren’t willing to come to the U.S. if their spouse can’t work,” said Stephen Yale-Loehr, a professor of immigration law at Cornell Law School.

Another revision announced Tuesday will ease requirements for applicants of an EB-1 work visa, which is issued to researchers and professors with extraordinary ability. To qualify, applicants for the visas currently must submit awards, scholarly articles and a host of evidence to prove their outstanding recognition in and contribution to a particular field. The new rule will allow applicants to present comparable evidence that is acceptable, the official said. The U.S. issues 40,000 such visas each year.

Kenyan man on attempted murder charge arrested for firearm possession in Lowell, MA

LOWELL — A week after a superior court judge drastically reduced cash bail, freeing John Wachaga while his shooting case was pending, the 20-year-old city man was back before a judge on Monday after he was arrested Sunday in a firearms case.

Wachaga, of 52 1/2 Huntington St., pleaded not guilty in Lowell District Court on Monday to charges of possession of a defaced firearm in a felony, carrying a loaded firearm without a license, carrying a firearm without a license, possession of ammuntion without a firearm’s identification card, and unlicensed operation of a motor vehicle.

Prosecutor Rachel Perlman explained that after conducting surveillance, Lowell police vice unit conducted a motor-vehicle stop on Gorham Street near Ellsworth Street at about 7 p.m. Initially police stopped a woman, a drug addict known to police, after police say they saw a drug deal involving the woman and a man in a car.

The woman told police she paid the man in the car the money she owed him from a prior marijuana purchase. When police stopped the car, which was being driven by Wachaga, they found he didn’t have a valid driver’s license. Police also spotted the handle of a black, 38-caliber handgun sticking out from under a seat, Perlman said.

Wachaga is already facing charges of armed assault with intent to murder and armed assault with intent to rob in connection with the Jan. 20 shooting of a 16-year-old Lowell boy on East Merrimack Street.

The 16-year-old survived with two gunshots to his leg. Jason Ruggs, 20, and Robert Loh, 19, both of Lowell, were also charged in connection with that incident.

His next court date in that case is June 22 for a prtrial conference.

When Wachaga was arraigned in Lowell Distict Court after the shooting, he was ordered held on $100,000 cash bail. After he was indicted, Lowell Superior Court Judge Edward P. Leibensperger on April 24 reduced that amount to $10,000.

Defense attorney Robert Normandin said Wachaga’s family “scraped” together the $10,000 to get him released the first time, but he suggested they could raise more than that this time.

Wachaga’s next court date in Lowell District Court on the new case is June 5.

Kenyan man stabbed to death in the US

Police in Baltimore, Maryland, are investigating a case in which a Kenyan man was stabbed to death over the weekend.

The Kenyan, David Mbugua, was fatally stabbed on his chest early Saturday morning.

According to police, an officer on patrol was flagged down by a group of people at the intersection of Charles and Baltimore streets in the wee hours of Saturday. When he stopped, he found a man had been stabbed multiple times.

“The officer called for an ambulance which arrived minutes later and the emergency personnel took the man to a nearby hospital where he succumbed to the injuries,” an eye witness told WJZ, a local Television Station.

According to Mwakilishi.com, a Kenyan online newspaper published in Baltimore, the victim was popularly known as DJ Davie.

“So far no suspect or motive has been identified,” said Mr Irungu Thairu of Maryland.

Baltimore police are requesting anyone with any information which would lead to the arrest of the perpetrator of the heinous act to immediately call 911.

“I will talk to the police in the morning to find out whether they will have come up with any new information,” Irungu said in a phone interview with the Nation Tuesday night.

7. Lorna Rutto, 28 – Founder, EcoPost
Lorna founded EcoPost in 2009having quit her job at a local bank. Her company that recycles waste plastics and converts them into durable fencing posts among other commodities has managed to generate 300 jobs and in the process earned Ksh 10.43 million or 120,000 US Dollars. For her environment conservation efforts, she was feted by Enablis in 2009. She has won several other awards since then. Lorna is an Accountant by profession.

8. Antony Mwaura, 24 – Dreamlt Computing Technology
Simply referred to as Tonnie, the young entrepreneur holds vast skills in IT and has mastered the art of turning ideas into reality. In 2010, he founded Deamlt Computing Technology. He however, has been working for Metrocomia East Africa as a Web programmer/ Developer since 2011. He holds a Higher Diploma in IT and has won awards for his innovations such as the Outstanding Developer of the Year Award, 2012.

9. Evans Wadongo, 27-Director of Operations, SDFA Kenya
Evans holds a bachelors degree from the Jomo Kenyatta University of Agriculture and Technology. He is testimony that great difficulties mould great men. As a child, he walked close to ten kilometers to school but rose to recognition by among other organizations, the CNN. In 2006, he joined the Sustainable Development For All-Kenya (SDFA Kenya). Evans was featured in CNN’s ‘Top Ten Heroes of 2010’. He was also recognized as one of the most influential African entrepreneurs under 30 by Forbes.

Kenya awards 7 oil blocs to Nigerian businessman Aliko Dangote

Nigerian businessmen have been awarded seven oil blocs for exploration from the 46 newly discovered oil blocs in Kenya, Kiprono Kittony, the Chairman of the Nigeria-Kenya Chamber of Commerce said.

The chairman made the disclosure in Abuja on Monday at a meeting with prominent business men from both countries.

The meeting was part of activities lined up for the state visit of President Uhuru Kenyatta of Kenya to Nigeria.

The closing session of the business meeting was presided over by Presidents Goodluck Jonathan and Mr. Kenyatta.

Mr. Kittony said the Joint Nigeria-Kenya Chamber of Commerce, inaugurated during a state visit of President Jonathan to Kenya in September last year, had yielded fruits.

During the President’s visit to Nairobi, Kenyan authorities had offered the 46 newly discovered oil blocs to interested Nigerian investors in the oil and gas industry to develop.

The chamber chairman added that it was exciting to see Nigerian investors coming to Kenya after the Jonathan visit, stressing that Kenyan Airways had increased the number of flights to Lagos to 10 in a week and promised to enhance the capacity of flights.

He noted that Kenyan Airways would from June 6, start direct flights to Abuja.

Mr. Kittony said there had been investments in the financial sector with three Nigerian banks now operating in Kenya, noting that “in the next four years, we will see increased business cooperation and flow of trade.

“We appreciate the support we got from government of both countries.’’

Mr. Kittony added that about 41 top business men from eight sectors accompanied President Kenyatta on the state visit, saying “we have representation from the manufacturing, hospitality, healthcare and financial services,

“We also have representations from information and communication technology, agriculture, cotton, textile and the real estate.’’

Aliko Dangote, the Co-Chairman of the Joint Chamber of Commerce and Nigeria’s business mogul, said eight companies from Kenya had established offices in Nigeria.

Mr. Dangote, who was represented by his brother, Sanni Dangote, said that in the area of food and beverages, Kenyan tea was now very popular in Nigerian markets.

He disclosed that there was a proposed establishment of hospitality training institute in Nigeria with technical support from Kenya.

Mr. Dangote added that given the immense popularity of the Nigerian movie industry in Africa, Nollywood’s proposed movie institute to be established in Nigeria would assist in the training of Kenyan actors.

Both Presidents Jonathan and Kenyatta promised to give necessary support to the business group to succeed.

[VIDEO] Kenyan nurse who raped heart patient in Plano, TX flees to Kenya

Debe Castro was an in-patient at The Medical Center of Plano in January 2013, preparing for a heart procedure. Medicated but conscious, she said her nurse — Wilson Karago — came to her bed in the middle of the night.

“He woke me up. He kissed me. He said, ‘You kiss, but you don’t tell.’ Something to that nature when he woke me up,” Castro recalled. “And I said, ‘Whoa, what are you doing here?’ And that’s when things escalated. The rape started.”

The day she was discharged, records show, Castro immediately went to Plano police to report the rape.

She had DNA evidence leading investigators to draw Karago’s blood. The DNA matched. Police said a Collin County grand jury indicted Karago.

But when it came time to arrest Karago, he had already fled the United States. He was back in his native Kenya, and that country will not extradite accused criminals to America.

So, without an arrest, this is still considered an active case. That means law enforcement won’t release any records.

It’s as if nothing ever happened.

“[Plano Police] had every opportunity, I feel, for him to have been picked up, especially because he was on a visa,” Castro said. “And nothing, to my knowledge, was ever done.”

Plano police declined to comment on camera. A spokesperson said the department understands Castro’s frustration, but this was a complicated case, and that’s why it took nine months to bring it to the grand jury.

Mike Sawicki is a Dallas attorney who is not involved in this case, but has handled similar cases involving patients who were sexually assaulted in hospitals.

“A warning sign can be if that nurse has moved several times in the past and doesn’t have a really good explanation for why,” Sawicki said.

  • In 2007, Karago was licensed in Indiana.
  • Later, in 2007, Pennsylvania granted him a license.
  • Then, in 2010, Karago popped up with a license in California.
  • In 2010, Karago finally arrived in Texas.

The Texas Board of Nursing has since revoked his nurses’ license for raping Castro.

“Are they moving because they want to see the world? Or are they moving because they’ve had a problem in X or Y facility and need to get away?” Sawicki asked.

The Medical Center of Plano declined to comment on camera, but provided this statement:

“The health of our patients is paramount and we do not tolerate behavior that jeopardizes their safety. As a matter of process we take various steps, including educational, employment and criminal background checks, in an attempt to determine that all of our employees are qualified and capable of providing high-quality care to our patients.”

Castro, who has not sued The Medical Center of Plano, said she is disappointed with its overall response.

“No one — even after the grand jury, all that was over with — no one even reached out. They waited for me to initiate. And all I wanted was an answer,” Castro said. “What steps that they had in place to protect their patients as they come and go out of there.”

Castro still hopes to get those answers.

But for now, she knows a grand jury believed her. The Texas Board of Nursing believed her.

And she wants her story to serve as a warning to others, instead of remaining a secret in the eyes of the law.

Kenyan Oscar winner Lupita Nyong’o on Saturday evening met with US President Barack Obama and his wife Michelle prior to the start of the 100th annual White House Correspondent’s dinner held in Washington DC.

Obama greeted Lupita in Swahili during the meeting which was held before the dinner.

The President and the First Lady are said to have met a group of  A-listers before the commencement of the dinner.

A White House spokesperson did not immediately respond to a request for comment on the meeting.

Cosmas Mbugua made a brief appearance in HaverhillDistrict Court after prosecutors asked a judge to movehis dangerousness hearing to a court accessible to his alleged victims.

Those alleged victims are two men, both over the age of 60, who are mentally and physically disabled.

Mbugua worked overnights in the Haverhill group home where they live.

“He was punched in the face, and my brother is mentally incapacitated,” saidPatricia Ward outside the courthouse.

Maryann Lawler described the abuse she said her brother suffered at the hands of Mbugua.

“He pushed him in a wheelchair (into a) closed door several times and then repeatedly punched him on the ankle,” said Lawler. “He has a broken tibia and a bruise the size of a baseball on his ankle.”

Mbugua, a 22-year-old from Lawrence, has worked at the home for about six months.

The director of Fidelity House tells WCVB a Criminal Offender Record Information check was performed when he was hired. It may have only revealed criminal convictions.

But Team 5 Investigates discovered Mbugua was arrested on suspicion of disorderly conduct and threatening to rape a nurse at Lawrence General Hospital in March 2013.

The case was continued without a finding, and he was sentenced to probation.

There is now a warrant out for his arrest for violating that probation.

In April, Mbugua was arrested on suspicion of gross and open lewdness when he was accused of exposing himself on a city bus in Lawrence.

Both times he was allegedly drunk, police said. Haverhill police say Mbugua was intoxicated when he was arrested at the group home on April 25.

“I just can’t believe this,” Ward said. “It’s disastrous.”

Mbugua is due in Newburyport district court on May 19.

Both of his alleged victims plan on attending the dangerousness hearing.

Safaricom reaches Sh15.5m settlement with musician JB Maina

Safaricom has reached a multi-million- shilling settlement with musician John Boniface Maina, popularly known as JB Maina, which is set to end a protracted legal battle over use of the singer’s ringtones.

JB Maina will get Sh15.5 million as compensation for the alleged use of his 10 songs as ringtones through the telecommunication firm’s “Skiza” tunes and “Surf 2 Win Promotion” without his knowledge — a charge that Safaricom denied.

“I JB Maina… being the plaintiff herein and having been informed of the offer from the defendant, Safaricom, to pay Sh15.5 million… I hereby authorise the firm of Gikunda Miriti and Co Advocates, who are my advocates in the matter, to apply for the case to be marked as settled,” says Mr Maina in a document filed in court.

Safaricom will pay the compensation within 21 days from Monday, the day when the consent was adopted, failure to which he can move back to court to compel payment of the sum.

The deal settles a suit that at one time last year saw the musician seek contempt of court proceedings against Safaricom and other defendants in the case.

The High Court in May last year restrained Safaricom from storing and selling Mr Maina’s Kikuyu songs and directed the mobile company to grant the musician access to its head office for him make copies of all purchases and sales records of his songs.

But Mr Maina says Safaricom did not comply with the court order, prompting the contempt of court suit.

He asked the court to find Safaricom CEO Bob Collymore and three other executives guilty of disobeying court orders issued in May.

The three executives are Alex Mwenga, CEO of Interactive Media Services; Sydney Wachira (head of Liberty Afrika); and Maurice Okoth, the chief executive of Music Copyright Society of Kenya. The agreement also settles the case against the other defendants.

The musician filed the suit demanding Sh5 million in damages in addition to any money due after accounting for the alleged illegal sale of his songs through promotions.

Safaricom denied the copyright charges, saying it signed a Content Provision Agreement with Interactive Media Services and Liberty Afrika Technologies, which are licensed by MCSK. The firm maintains that payments linked to downloads of Mr Maina’s music were made to Liberty Afrika.

[VIDEO] Al-Shabaab corrupts Kenya’s national anthem with veiled threats

Islamic militant group Al-Shahab released a corrupted version of the Kenyan National anthem veiled with threats against Kenyan leaders and the Kenyan people.

The Al-Mujahadeen camp of the Al-Shabaab released a video with various chants of terror featuring various tunes which many in Kenya especially the coastal region may be familiar with.

The video was posted on May 5th on Youtube. The information of the video stated: “Fight them, and Allah will punish them by your hands, cover them with shame, help you (to victory) over them, heal the breasts of Believers.”

The video which features songs in Kiswahili also carry veiled threats towards former president Mwai Kibaki, President Uhuru Kenyatta and former Prime Minsiter Raila Odinga. It is not clear why these specific leaders are mentioned and some school of thought is that although the video was posted on youtube this week, it may have been made prior to the 2013 Kenyan elections

In the video, the militants sing about taking up Jihad and slaughtering the enemies with a verse that says “Natubebe silaha zetu, ee ndio wajibu wetu, makufar watakiona kiama, Natuwapige risasi, na kisu shingoni hatutaki huruma ama amani.”

In the last few weeks Kenyans have encountered terror in Nairobi as well as Mombasa.

Oburu alleges plot to assassinate Raila Odinga

An ODM nominated MP has sensationally alleged that there is a plot to assassinate former Prime Minister Raila Odinga.

Addressing the Press in Bondo after attending the inaugural graduation ceremony at Jaramogi Oginga Odinga University of Science and Technology in Siaya County, Dr Oburu Oginga claimed there were ‘senior’ people in East Africa who were plotting to assassinate his brother, who is Coalition for Reforms and Democracy leader.

“I am reliably informed that a president of a neighbouring country alleges the many problemsKenya currently faces are caused by Raila Odinga,” said Oburu. He said the allegations cannot be taken lightly.

Oburu said he will recorda statement with police if called upon to do so.

Maina Njenga goes into hiding as his brother leads Mungiki ‘coup’

The former leader of the banned Mungiki sect Maina Njenga has gone into hiding following attempts on his life by disgruntled followers of the group.

The Nairobian has reliably learnt that Njenga’s older brother, Peter Kamunya, is leading a splinter group that is dissatisfied with his leadership.

The splinter group was responsible for a deadly attack on May 4 in Kitengela town in which Njenga escaped death by a whisker.

Five people were seriously slashed with pangas in a fight, which sparked a spate of night-long retaliatory attacks between the supporters of the two brothers.

The chaos spilled into Monday May 5 morning with the sect’s adherents battling in the streets of Kitengela.
At the heart of the rebellion is the control of Mungiki’s assets — mainly land, whose worth is believed to be running into millions of shillings.

Quit Christianity See also: Sect kills own men over parastatal land Another bone of contention is a proposal by the Kamunya group for Mungiki to return to its old notorious ways of murder and extortion, a suggestion that Njenga is opposed to.

Trouble began on Sunday, May 4 evening when for the first time in public, Njenga rubbished Mungiki members who wanted him to quit Christianity.

“There have been people here, among you who tell me we should go back to the old ways. I refuse. I tell you no. Let me serve God in peace,” he said.

Maina was addressing a crowd atop a makeshift platform in the compound of his church, Hope International Ministries, in Kitengela after church hours.

The meeting had been requested by the disgruntled Mungiki adherents for Njenga to clarify his position on the sharing of the property and their desire to return to the streets.

To these requests he said: “People tell me about the house of Mumbi and sniffing tobacco. I say, hayo ni mabo yaliopitwa na wakati. Haturudi huko nyuma.

(Those things are out of fashion and we will never go back again)” As he finished uttering the no-going-back declaration, palpable tension hung over the church’s air.

He hurriedly closed the meeting but no sooner had the last person set foot out of the church, than violence broke out.

A slugging match between Mungiki adherents dissatisfied with his statement and his bodyguards ensued and it rapidly degenerated into a full confrontation. In the confusion, Maina slipped through to his car, a black Hummer, which sped off. Kamunya, who was present at the church, also fled.

Later that evening, Mungiki members started attacking the converted members who were in Maina’s church with pangas.

All-out war

The church members fought back and the Mungiki members retreated into the night to regroup and returned for a revenge mission early the next day.

“Six people were slashed to death that Sunday (May 4) night, and several others were admitted at local hospitals,” said a source close to Njenga.

He disclosed that on the particular night, Maina headed to his Kitengela home but was alerted that an ambush lay in wait. He then turned and spent the night in an undisclosed location.

The next morning, Mungiki adherents poured into the streets of Kitengela to avenge their colleague’s deaths and slashed 13 people in the process.

It is said one person died during the fracas. Several of them were arrested by police but by that time, our source revealed, the group allied to Njenga’s brother had declared an all-out war.

On Tuesday morning, Mungiki staged a dawn attack on Maina Njenga’s Kitengelahome hoping to get him asleep. In the ensuing fracas Njenga’s bodyguard was slashed to death.

Since the Sunday of May 4, people close to Maina Njenga reveal that more than 50 people have been killed in a war between Njenga and his brother.

“You only know about the ten deaths since Sunday, but I can confirm to you that more than 50 young men have died since Maina publicly declared in his church that he isn’t going back into Mungiki,” said our source.

The 50 people, he said, might not have necessarily died in the clashes in Kitengela, but in other clashes in Mungiki strongholds in Kenya. Another source close to the splinter group said that, a ‘general’ was sent on Wednesday to Nyandarua tomarshal forces in preparation for what they promise will be a war of attrition against the Njenga group.

“We expect him to be back by Thursday or Friday. Alienda kutafuta jeshi sababu huku Nairobi na Nakuru, ni watu wa Maina Njenga. Liwe liwalo, Maina lazima amalizwe (he went to look for an ‘army’ because Njenga must die),” he said.

Nyandarau is Njenga’s birthplace but it is now believed to be the bedrock of his estranged brother Kamunya, who is seeking to eliminate him. It is thought that the bulk of Maina’s followers are in Nairobi and Nakuru where he is said to have founded the movement in the late 1980s.

Our source said the splinter group is no longer interested in talks and has vowed Maina must face the ultimate punishment for turning his back on the sect. “Maina swore an oath when he was in Mungiki: never to leave the group or reveal its secrets. He personally made others swear the same oath.

Now he has left the group. What befalls the others he has left behind?” asked oursource in Kiswahili.
The genesis of Njenga’s problems with Mungiki started way back in 2009 when after being acquitted of a criminal offence, he got saved and renounced the sect’s activities.

But the differences became pronounced last July when a Mungiki regional commander allegedly stabbed Maina in the abdomen after a disagreement in his vast Kitengela estate. Although he vehemently denies the incident, witnesses claimed the incident occurred when Njenga called a meeting of other Mungiki members to discuss how to share the group’s wealth. “Mungiki members feel that during their heydays, before Maina converted to Christianity, they made a lot of money and they were well taken care of.

Ever since Maina got saved, times have been hard on members and it was decided that it was better to share the wealth Maina acquired through Mungiki.

That way, Maina will remain with his church while Mungiki can continue with their activities,” said our source.

At the height of its influence, members claim the group boasted as many as 500,000 members and collected Sh2 million daily in extortion fees.

From these proceeds, Mungiki is thought to have bought about a piece of land in Kitengela,estimated by some members to be 1,000 acres and other undocumented properties around their strongholds. Members from the splinter group say that majority of these properties are registered in the name of Njenga, and now they want them shared out equally.

Njenga owns a house in Kitengela, and another one in upscale Karen, which borders an estate where some of Kenya’s top politicians live.

Efforts to reach Njenga throughout the week bore no fruit as his aides who had promised us an interview said he was too busy to honour it.

Ruth Matete: So what if I am broke?

Friendly, cheerful, and outgoing could all start to describe her even though she has been on the receiving end of bad publicity. But this has not killed Ruth Matete’s jolly character.

Ruth has been enveloped by controversy from the minute she was announced winner of the music reality show Tusker Project Fame. After a year away from the media spotlight, she has finally come out of her cocoon ready to take on her haters.

“I have come to accept the media. Although they slander me all the time, I realise that I need them in my music career,” she begins, oozing confidence.

It seems that she has a strong relationship with God because she quotes Bible scriptures frequently.

And when I go straight to the point and ask her the questions that everyone wants answers to — about being crazy and broke — she laughs a little and says, “I know I have done some crazy things in my life but losing it completely; never. Look at me now. I am perfectly sane. I do not believe someone who has actually gone crazy can make the transformation that quickly and be able to hold conversations or go to interviews.”

Accursed

The whole Ruth-Matete-gone-crazy story started when she decided to reduce the length of her long dreadlocks, eventually shaving them off completely. (She now sports a short, spiky crop). For some reason, certain people associated that with being crazy.

“It is really unfair when someone writes something when they are not sure about it. Even if I am broke, that is my private life. It is my problem, not theirs. I do not go round telling the world how they should spend their money so why are they so concerned about mine,” she queried.

“He who trusts a man is cursed,” she says. Yes, it is another quote from the Bible she drops, saying that this is what she has learnt over time after having trusted so many people who are the same ones who put her in trouble.

Her latest medal of shame was the dress she wore during the grand finale of Tusker Project Fame Six. The dress was so daringly short that it would likely make hardened Kenyan socialites blush. It roused the worst of Kenyans on social media with many viciously attacking her.

Just human

“At the end of it all I am human and it does not mean that now that I am saved (local lingo for practicing Christian) I have turned into an angel. There is no one to blame for the dress and I know some might argue that I should have said no, but I had already signed a contract and there was no turning back.”

The story behind the dress is that she arrived late at the ceremony and was quickly handed the dress by a stylist. She clarified that she had worn such dresses before while in the Academy except that at the time the public had no knowledge of her salvation.

Now they had taken it upon themselves to ensure she exercised the decorum in whatever she did.

Homeowners flee Ngong as thugs terrorise estates

Hardcore gangsters have taken over a neighbourhood on the outskirts of the city, forcing home owners to abandon their mansions and rent houses in safer locations.

Mr Isaac Parashina is one such homeowner. In just five months, the gangsters have attacked him three times, forcing him to abandon his newly built three bedroom mansion in the Bondeni area of Ngong and rent a house in the relatively safer Ongata Rongai.

In the latest attack two weeks ago, a gang of five broke into his home after shooting the night guard.

“The guard narrowly escaped death; they shot him at the chin and thought he had died,” a neighbour recounted, requesting not to be named for fear of attracting reprisals from the gangsters.

“The gangsters stole assorted household goods including mobile phones, cash and electronics during the attack,” said the neighbour.

Late comers

“The police arrived late, long after the gangsters had terrorised us. In this place, neighbours hardly come to the rescue of one of their own whenever such attacks happen,” the man said.

After attacking Mr Parashina, the gang went to another home about 200 metres away and defiled a 12-year-old girl as her parents watched in horror. They left after robbing the family of household goods.

Days earlier, another resident had been carjacked as he drove home at around 9 pm.

The carjackers used his phone to ask his relatives to send money to him via M-pesa failure to which they would harm him, the man said.

Once they had collected a substantial amount and transferred it to their M-pesa accounts, they dumped him in Ongata Rongai. His vehicle was later recovered in Kiserian.

“It is a well organised gang. I once encountered them, they all wore police uniforms and they seem to know this area very well,” he added. Mzee Paraset Sindeu, who has lived in the area all his life, said the gang has poisoned more than ten dogs in various homes before committing the robberies.

A resident, only identified as Mama Wanjiru said her two dogs were killed by the gangsters before her home was attacked.

She told of her next door neighbour who has been attacked more than six times since moving to the area. In the latest robbery, they tied the children using neck ties in one room, ransacked the house before using the family car to ferry away the stolen goods.

Abandoned car

The vehicle was found abandoned in Ongata Rongai two days later.

Last year, veteran politician Abuya Abuya was attacked and robbed of his vehicle and other valuables in the same area. To date, the vehicle has not been recovered.

In the latest attack on Sunday night, a bodaboda rider was attacked and killed by gangsters who also stole his motorcycle.

A few hours earlier, a gang had attacked a home in the area and seriously injured one person before stealing household goods.

The attack prompted officers from the Ngong police station four kilometres away to swing into action, gunning down the gang’s suspected ringleader.

The officers raided the suspect’s shanty in Ngong’s Mathare slums and shot him dead.

According to police reports, the suspect only known as Mbugua, a father of two, shot at the police before being gunned down. His wife was seriously injured and rushed to Kenyatta National Hospital where she is receiving treatment.

Residents blamed police officers for failing to deal with the insecurity in the area.

Area chief Joseph Lempeiyan, however, said police had intensified patrols and plans were underway to open a new police post.

Ngong OCPD Farah Mohammed said security had been beefed up in Bondeni.

“We have increased security patrols in Bondeni and that is why crime has drastically reduced,” he stated.

Kenyan family searching for missing kin in US

A family in Kenya is searching for their missing kin who lives in the United States.

Carne Mururi Mwangi, 32, has lost communication with his family back home and the family has been worried about his safety and welfare.

Speaking to Jambonewspot.com from Kenya, Mururi last spoke to them in August 2013 where he informed them that he would travel home in December 2013 which he never did. There was no communication as to the cancellation of the trip and the family has lost contact since.

Mururi is said to have been living in the Seattle, Washington area before moving to Denver, Colorado. The family is not sure of the dates.

He left Kenyan in September 2002 and landed in the Washington DC area.

Mururi is from Kaloleni, Nakuru.

His family also says that at one time., he lived in a shelter for homeless people in a location they do not know.

The family is seeking assistance in locating him and letting them know of his whereabouts as he may be in need of help and has not reached out.

[VIDEO] Why do this to me? Kenyan girl asks mother who eloped with lover who raped her

At Kaloo village in Mwingi Central sub-county, Kitui County, a girl is tethered by cruel life. Mwende (name changed to protect her identity) is only 15 years old but she has been to hell and back.

With her improvised crutches, the emaciated girl wobbles out of their mud hovel with sunken eyes bearing a blank, agonising look. She sits on a piece of wood and coils herself as if scared of life. The stench emanating from within her is evidence of untold horror. She bends her head and feebly begins to swat a swarm of houseflies hovering over her. Her stunted physique betrays her age.

Once a bubbly girl, Mwende thinks of the old school days and wishes she could turn back the clock. But she cannot. She is paralysed from waist down due to a brutal sexual ordeal meted on her three years ago.  With some prodding from guardians, Mwende opens up and faltingly narrates her ordeal. She remembers the day clearly as she does her attacker, a man who has been freely roaming the streets as she wastes away.

On September 13, 2011 at around 1pm Mwende met the ‘devil’ who would tragically change her life. She was then a Class Three pupil aged 11.

“I was coming from school and was just a few metres from our home when I saw him approach. I used to see him with my mother so I did not think much of it,” she says. On this day, however, the man identified as Peter Nzuka, who was her mother’s lover had an ulterior motive.

He grabbed the girl and shepherded her to a nearby thicket.  “He stepped on my thigh hard and I felt my bone crack,” Mwende says. Having subdued the girl, the assailant defiled her until she could scream no more. The girl was now bloody, the beast had accomplished its mission.

But what happened immediately remains a big puzzle to Mwende up to this day. Her biological mother emerged from nearby and together with her assailant carried the hapless girl and locked her in their house. She stayed in this house for three weeks before anyone got wind of her tribulations as her mother and lover went on with their business without a care in the world.

Her paternal grandmother Mbisu Mengi noticed the girl’s curious absence and confronted the mother. She was dismissed with a wave of the hand.  “She casually told me she had sent the girl to her maternal grandmother. After asking around, I found it was a lie. That is when I summoned her aunt and together we demanded to know the girl’s whereabouts,” she says. The mother relented and directed them to her house. What the women saw broke their hearts. Mwende was now a caged animal, smelly, weak and on the verge of death. The women wept uncontrollably.

“They used to tie me on the bed and lock the door,” says the girl of the beastly act dispensed by her mother and her lover.  The area chief, Samuel Maithya, then summoned his officers and rushed the girl to Mwingi District Hospital where doctors noted severe injuries inflicted through sexual assault.  “She was in a terrible state. She opened up to the doctors and told them of the sexual assault she underwent through a person she knew,” Maithya said.

The hospital, however, could not adequately handle the case. She was referred to Embu Provincial General Hospital (PGH) for specialised treatment.

Despair and anguish

Due to lack of money, Mwende was discharged from Embu PGH to await her fate at home. Every passing day brings with it despair and anguish of untold proportions.  The chief says the suspect was later arrested and arraigned in Mwingi Law Courts where he denied defiling the girl.

He was remanded at Waita GK prison for two years as the case progressed, says Maithya. However, the devil in her mother struck again. The girl’s father Zakayo Mathembe who had now returned home from Kangundo in Machakos County where he worked as a farmhand says his wife set all the medical documents concerning their daughter’s case on fire.  This gave her boyfriend a smooth ride to freedom. He was finally acquitted for lack of evidence. He then eloped with the girl’s mother to an unknown destination.

Does the girl have an idea why her mother would conspire with her lover to harm her?  “I blew up their scheme to sell my father’s timber and they became bitter. Nzuka warned me that he would punish me. My mother told me to stop meddling in their affairs,” she explains.

Mwende’s grandmother Mengi  says the man befriended her daughter-in-law while her husband was away. “I demanded to know what he was doing with a married woman at her matrimonial home but they both became hostile and threatened me.

Fearing for my life, I kept a distance from their affair,” Mengi says.  The girl’s grandmother and her jobless father have hit a dead end. Mwende’s left thigh has burst into lesions and the boils ooze  pus.

“She is not getting any medication at all. The only thing we can afford is aspirins to alleviate her pain. As you can see, those don’t help much,” says a forlorn Mathembe with a tinge of sadness in his voice.  Mwende says she would like to go back to school.

This however will remain a pipe dream unless she receives specialised treatment, which her family cannot afford.
